Michael Jackson Removed From Copyright Lawsuit
Great news for Michael Jackson has come out of his hometown Gary, Indiana. A federal judge has cleared him of any liability and having any involvement in the release of the 1996 Jackson Five compilation, "Pre-History: The Lost Steeltown Recordings". He will no longer be included as a defendant in the civil case filed by the producer and members of the R&B group, Ripples and Waves founded in the late 1960s. The group accused Michael of misrepresenting their work as his own on the compilation cd.
In the judge´s ruling, "Jackson has testified that he had no involvement in the production or release of the album, that he did not select or approve of the songs on the album (and) that he did not receive any royalties from the album."
U.S District Court Judge, Phillip Simon granted Mr. Jackson´s motion for pretrial judgment, also noting that two of the songs on the album, "Let Me Carry Your School Books" and "I Never Had A Girl," were written and recorded by Ripples and Waves.
Judge Simon was not convinced that Brunswick Records, the company who released the cd in question, had a right to distribute the songs.
The liability of the lawsuit specifically applies to producer Gordon Keith, the only plaintiff who failed to reach an earlier out-of-court settlement with Jackson.
In 2003, Michael Jackson had to make two trips to Indiana for deposition in this case. In May, the deposition was postponed because Jackson suffered from an anxiety attack. He came back a month later to complete his deposition.
The next day he went to Gary, Indiana to visit his old family home on 2300 Jackson Street, received a key to the City, visited Roosevelt High School where his brothers attended, and had a ceremony at a football game later that night. Many of Jackson´s fans lined up around City Hall and Jackson´s boyhood home to show him support and love on his return to his birthplace.
According to Nielsen SoundScan, "Pre-History" has sold 6,000 copies. Far from "Gold record status" that equals 500,000 in sales.
The case will go to trial next month.
