A day after illness aborted lawyers' attempts to question Michael Jackson, a federal judge told attorneys the King of Pop have to return for his deposition within three weeks.
Grover B. Davis, an attorney involved in the case, said U.S. District Judge Philip P. Simon also told Jackson's attorneys to file papers documenting the illness that led to the cancellation of Wednesday's deposition.
Davis said the deposition, which was being taken at the Canterbury Hotel, never got underway. Scheduled to start at 2 p.m, the deposition was put on hold from 3:30 to 5:30 as eight attorneys and the three people suing Jackson waited to see if the singer's health would improve.
At 5:45 p.m., the attempt to question Jackson was called off, said Davis, who represents the Brunswick Record Corp.
The company and Jackson are being sued in federal court in northern Indiana for infringing on a copyright and trade name in the release of a 1996 album of early Jackson 5 recordings.
Simon had ordered Jackson to appear in Indianapolis for questioning to answer questions from attorneys representing a music producer and two members of Ripples & Waves, the group that allegedly performed two of the songs.
"He felt weak and tired and it got worse as the day went on," Jackson's publicist Stuart Backerman told The Star.
Brian Oxman, a long-time attorney for the Jackson family, said depositions are upsetting to Jackson. "He doesn't like lawsuits. He doesn't eat and he doesn't take care of himself because he's so worried."
Oxman did not know which hospital Jackson, 44, was taken to. A source told The Star that Jackson was admitted to Methodist Hospital under an assumed name.
A Methodist Hospital spokeswoman said they had no patient by the name of Michael Jackson. Federal regulations prohibit hospitals from releasing information without the patient's consent.
Oxman said Jackson's illness has forced the singer to cancel a trip planned for today to Gary, where he grew up. Jackson was to receive the key to the city and visit the house where he grew up.
It would have been Jackson's first trip back to Gary in 20 years, Backerman said.
"It was going to be a very positive, warm, emotional celebration," he said. "Believe me, he wanted to do that very badly." """

Indianapolis, May 22 - Michael Jackson checked into Methodist Hospital Wednesday night. But his sickness didn't get him out of court ordered deposition involving a copyright lawsuit.
A judge ordered the King of Pop back to Indianapolis to face questions.
Ed Jenkins asks, "Why should he be exempt because of his celebrity status. I couldn't. You couldn't."
And Clara Young says, "He was here to give his deposition. Perhaps he wasn't able to do it, I guess. They would tell me to come back."
Ripples and Waves singers Elvy Woodard and Ivan Michael filed suit against Jackson, his brothers and a record label. They claim the Jackson 5 stole two songs and their group name.
Jackson appeared healthy getting off his private jet upon arrival to Indy. He even brought his three children.
During his stay Jackson visited the Circle Centre Mall and even took in a movie Tuesday night.
But sources tell Channel 13 that just prior to deposition time the one glove wonder became ill. He asked to go to the hospital.
After treating and releasing him, doctors wrote Jackson a prescription.
"He is under a lot of stress all the time. He seems like a nervous person," says Carolyn Swickert.
During a status hearing with the attorneys in the case, the judge ordered Michael Jackson's return to Indianapolis within three weeks to give his deposition.
The judge says Jackson will be slapped with a $1,000.00 per day fine if he's a no show.
Swickert says, "If it was anybody that wasn't famous they would have to come back, so I think he should have to come back also."
"Him having all the problems in his hometown, of course he should have to come back," says Imhotep Ngozi.
When and if Jackson does come back to Indiana, attorneys for the Ripples and Waves will be ready to flood the King of Pop with questions.
Because of the new confidentiality laws the hospital can't talk about Michael Jackson's visit. In fact, doctors can't even say he was there.
But Jackson must file court papers about his illness.
The attorney for the record company named in the lawsuit says he'll hit Jackson with a line of questions too during the deposition when it happens."""
